Terms of Service

These Terms of Service (“Terms”) govern all services provided by Evergreen SEO Agency (“we,” “us,” or “our”) to you (“Client”). By completing payment for any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Services

We provide local SEO and digital marketing services on a month-to-month basis. Services may include any combination of local SEO optimization, content creation, Google Business Profile management, website design and maintenance, link building, citation building, paid advertising management, and related digital marketing services.

The specific services included in your subscription and your monthly fee are as specified at the time of purchase and confirmed in your subscription receipt or checkout summary. Where services are itemized separately in your subscription, each line item represents a discrete service deliverable billed at the rate shown.

Additional deliverable detail may be outlined in a scope of work sent to you before or alongside your first invoice.

2. Payment Terms

• •Services are billed monthly. Your billing date is set on the date of your first payment.
• •Payment is due on or before your billing date each month.
• •We accept payment via invoice. Instructions are included on each invoice.
• •Services may be paused if payment is more than 7 days late.
• •By completing payment, you agree to these Terms in full.

3. Cancellation Policy

• •There are no long-term contracts. Services are month-to-month.
• •To cancel, provide written notice at least 30 days before your next billing date via email to maxx@evergreenseo.agency.
• •Payments already made are non-refundable. You will continue to receive services through the end of your paid period.
• •We reserve the right to cancel services at any time with 30 days notice.

4. No Guarantee of Rankings

SEO results depend on many factors outside our control, including search engine algorithm changes, competitor activity, and website history. We do not guarantee specific rankings, traffic levels, or revenue outcomes. We guarantee consistent, professional execution of agreed deliverables and transparent reporting on progress.

5. Client Responsibilities

• •Provide access to your website, Google Search Console, and Google Business Profile within 5 business days of first payment.
• •Respond to content approval requests within 5 business days. Delays may push deliverable timelines.
• •Ensure you have the legal right to publish all content and materials you provide to us.

6. Intellectual Property

All content, copy, and assets created by Evergreen SEO Agency on your behalf become your property upon payment in full for that month. We retain the right to reference your business as a client for portfolio and marketing purposes unless you request otherwise in writing.

7. Limitation of Liability

Our total liability to you for any claim arising from our services shall not exceed the amount paid in the most recent month of service. We are not liable for indirect, consequential, or incidental damages of any kind.

8. EverConnect by Evergreen SEO Agency

EverConnect is the app we use to connect your social media accounts to our services. Its name is “EverConnect by Evergreen SEO Agency,” and it is operated by Evergreen SEO Agency. These Terms apply to your use of EverConnect.

TikTok integration. EverConnect lets you authorize us to work with your TikTok account through TikTok's official login and API. When you authorize, you allow us to:

• •read your basic TikTok profile information and account stats (user info);
• •list your videos and read their performance (video.list);
• •upload and publish videos and posts to your account on your behalf (video.upload and video.publish).

We use this access only to run the social media services you hired us for. We do not sell your data, and we do not use it for any other purpose.

Revoking access. You can revoke EverConnect's access at any time in your TikTok app under Settings and privacy, then Security and permissions, then Apps and websites (the path may change; TikTok controls that menu). You can also email maxx@evergreenseo.agency and we will remove stored tokens and stop posting. After you revoke, we can no longer access your account.

Your content. You keep ownership of your TikTok account and the videos, posts, and comments on it. You give us permission to post and manage content on your account only as you have asked us to. You confirm you have the rights to anything you give us to publish.

Your data. How we collect, store, and delete information from EverConnect is described in our Privacy Policy.

TikTok's terms. Your use of TikTok through EverConnect is also subject to TikTok's own Terms of Service and Privacy Policy. If these Terms and TikTok's terms conflict on how your TikTok account may be used, TikTok's terms control.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms. We will notify active clients of material changes via email.
